Terms of Service

Effective date: May 2, 2026

These Terms of Service (the “Terms”) form a binding agreement between you and 51 Project (“we,” “us,” or “our”) governing your access to and use of the Atmos mobile application and the website at atmosweatherapp.com (together, the “Service”). By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian. By using the Service you represent that you meet these requirements.

2. Accounts

Atmos uses Sign in with Apple as the only sign-in method. You are responsible for maintaining the security of the Apple ID associated with your account. You agree to provide accurate information and to promptly update it if it changes. We may suspend or terminate accounts that violate these Terms.

3. Atmos Pro subscriptions

Atmos offers an optional auto-renewable subscription called Atmos Pro at $2.99/month or $29.99/year. A 3-day free trial may be offered at our discretion to first-time subscribers.

• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription automatically renews at the same price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel subscriptions in your Apple ID Subscription settings after purchase. Uninstalling the app does not cancel the subscription.
• If you cancel during a free trial, the trial ends immediately and you will not be charged. Apple does not provide partial refunds for unused subscription periods.

Pricing, features, and trial availability may change. Material changes will be communicated in the app or by email at least 30 days before they take effect.

4. Apple Standard EULA

Your license to use the Atmos app is also governed by Apple’s Licensed Application End User License Agreement (the “Apple EULA”). You acknowledge that Apple has no obligation to provide maintenance or support services for the app, and that Apple is a third-party beneficiary of these Terms with respect to the app.

5. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract source code from the Service, except where permitted by applicable law;
• Scrape, mirror, or systematically copy forecast or radar data delivered through Atmos for redistribution;
• Resell, sublicense, or commercialize the Service without our written consent;
• Use the Service to violate any law or third-party right;
• Interfere with or disrupt the Service or its servers;
• Misrepresent your identity or impersonate another person.

6. Forecast data and AI insights

Forecast data is provided by third-party meteorological services including Open-Meteo and RainViewer. AI insights are generated by OpenAI’s gpt-4o-mini model based on the underlying forecast data, with a deterministic local fallback when the AI service is unavailable.

Weather forecasts are inherently uncertain. The Service is provided for informational purposes only and is not a substitute for official government weather warnings, professional meteorological advice, or life-safety decision-making. Do not rely on the Service for aviation, marine, life-safety, emergency-response, or any other use where an inaccurate forecast could lead to injury, death, or significant property damage.

7. Intellectual property

The Service, including its software, design, branding, copy, and original content, is owned by 51 Project or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. All rights not expressly granted are reserved.

8. Feedback

If you send us feedback or suggestions, you grant us a worldwide, royalty-free, irrevocable license to use, reproduce, modify, and otherwise commercially exploit that feedback for any purpose without compensation or attribution.

9. Termination

You may stop using the Service at any time and delete your account from Settings → Account → Delete Account. We may suspend or terminate your access if you violate these Terms or if continuing to provide the Service is not commercially viable. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, indemnity, governing law) will survive.

10. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT FORECAST DATA WILL BE ACCURATE OR TIMELY.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL 51 PROJECT, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $50.

12. Indemnity

You agree to defend, indemnify, and hold harmless 51 Project, its affiliates, and their respective officers, directors, employees, and agents from any claim, demand, or damages, including reasonable attorneys’ fees, arising out of or related to your use of the Service or your violation of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts. Nothing in these Terms limits your statutory consumer-protection rights.

14. Changes to these Terms

We may revise these Terms from time to time. The current version will always be posted at https://atmosweatherapp.com/tos. Material changes will be communicated in the app or by email. Continued use of the Service after a change constitutes acceptance.
